What is Personal Data

This policy will more specifically address the personal data we collect, transfer, use, and disclose, which generally includes name, address, telephone number, email address, date of birth, billing and payment information, account information, and other information that specifically relates to you, which we collect in the course of providing our marketing communications, goods, and services to you.

Information We Collect Online

1. General Browsing

We collect general information about our visitors’ experience with our Websites/Apps and this general information is not connected to personally identifiable information about individual visitors. This general information (for example, domain type, browser version, service provider or your IP address) will provide us with information regarding the general use of our Websites/Apps. The information collected includes which pages our visitors are viewing on our Websites/Apps and whether visitors arrived through a link for our Websites/Apps. It also includes information on the type of browser and service provider used. For visitors using a mobile version of our Websites, this includes technical information about the device used, such as screen size, cookies supported by the device, and how images may appear. All of this information helps us provide a better experience for our visitors by being able to determine such things as how to best format our mobile Websites/Apps for various devices, our most desired pages, products and features, how to best direct visitors to our Websites/Apps, and where there might be browser or service provider connection issues.

2. Location Information

Our Website, Apps, and communications may use your IP address to determine the approximate location of your Internet Service Provider (ISP). This allows us to tailor content to you, such as a map of nearby stores. Mobile devices include your cell phone, and could include your laptop or tablet depending on the type of wireless connectivity used. If you do not consent to provide or disable location-based services, we may ask you to manually select the region where you are located, or to enter your zip code; if you chose not to provide this information some features of the Websites, Apps or communications may not be available. 3. Personal Data

Contact Us and Click to Chat

If you complete a general "Contact Us" form on one of our Websites we may collect your name, email address, and any information that you provide in the text of your message.

If you use the Click to Chat feature on our Websites we may collect your name and any additional personal data or other information that you provide throughout the communication.

Sign Up for Marketing Email List

If you sign up for our marketing email list, or the marketing email list for any of our affiliate brands, you will be asked to provide your email address. Our affiliate brands are: Hollister Co. and abercrombie kids. Signing up enables you to receive information about products and offers that we provide via email. Once you sign up you will receive an email to the email address you submitted confirming you are subscribed. In some locations on our Websites/Apps you are given the opportunity to submit additional information, such as gender and date of birth, that will help us cater messaging and marketing emails we send to you. In addition, we may identify you when you click a link in an email to get to our Websites, and may personalize messaging, promotions or product recommendations. You can choose the frequency with which you receive marketing emails or unsubscribe if you no longer want to receive marketing emails from us. See the Opt Out section below for more details.

Sending Electronic Postcards or Emailing an Item to a Friend

When you send an electronic postcard, or email an item to a friend from our Websites, the designated recipient will receive your name and email address, as well as any information you entered in the message. The email address information of your recipient is not used for any marketing purposes by us or our affiliate companies unless they have already submitted it for this reason, nor is such information rented, sold or exchanged with third parties for their marketing purposes. We do not review any information provided in the message content. You should not send postcards or items to friends unless you believe your friend would be interested and want to receive the information.

My Account

You are given the opportunity to create an account on our Websites and Apps. Creating an account requires you to enter your email address, first and last name, and to create a password, and allows you to provide postal addresses, a phone number, payment details, date of birth, gender, and favorite categories. By providing this information we are able to offer you a more personalized experience on our Websites, Apps, and in communications. In addition, we may identify you when you sign into your account and we may personalize messaging, promotions or product recommendations. Some of the features in the account section allow you to create an address book, save a wish list, subscribe to and update your marketing email frequency, access your order history, and enjoy "quick checkouts" by having us automatically enter your name, phone number, email, postal address, and payment details in the checkout process. When you create an account you will receive a welcome email that will be delivered to the email address you inserted into the email field on the create an account page.

To request to have your account cancelled, please use the Contact us section of the Help page and include the email address associated with the account you wish to cancel.

My Account – Payment Info

If you choose to add a payment type in the account section, you will be able to access this information during checkout when you are signed in. Your preferred payment type will pre-populate during checkout, or you can pick another type by selecting from the drop down list if you choose to save several payment types. If a payment card has expired we will indicate this by highlighting it in red on the Payment Info page, and you can remove this expired payment type and insert a new one if desired. You will have the option to add a new payment type during checkout by ticking a box indicating that you want to store the newly entered payment details in your account. If you reset your account password your payment types will be deleted from your account for security purposes.

My Account – Address Book

If you have created an account on our Websites or Apps you may use the personal address book which allows you to save all of the different names and addresses to whom you frequently send purchases or gifts. When you want to send a purchase to someone in your address book, sign into your account and once in checkout you can choose from the saved address list.

My Account - Forgot Password

If you forget your password and select to reset it you will be asked to insert the email address for your account so we can send you an email. Once you receive the email click on the link provided and when you are directed to the Website, enter and submit a password that meets the requirements to reset it.

My Account - Update Information

When you sign into your account you may be directed to an update information page. In order to proceed to your account you will be required to insert your first and last name, enter a password that meets the requirements, and agree to the legal terms as stated on this page. In addition, if you fill out the needed information on this page and submit it, and you are previously signed up to receive marketing emails, you will now receive marketing emails catered to your location.

Sold Out or Product Email Alert

If you provide us with your email address to contact you when a product on the site is available for purchase or to show interest in a product, the email address you submit will only be used for such purpose. The email address will not be used for any additional promotional purposes by us or our affiliate companies, and will be purged after the email(s) are sent or if there is no longer a need to maintain the data. You will, however, be able to sign up to receive marketing emails via a link in the footer of the product alert email that you may receive.

Purchasing at the Online Store

If you purchase merchandise through our Websites, we will gather your personal data (including your name, billing and shipping address information, email address, telephone number, banking and payment information), as well as information about your purchases on our Websites, which we may combine with your store purchase information. In addition, if you have created an account you will be able to view your order details in the account section. Some information provided in checkout may be used to personalize a future visit or communications, to cater products or offers to you or shared with affiliates or third parties for our marketing or advertising purposes.

Surveys

We will collect information when you fill out a survey offered on our Websites or in communications. This information will assist us in gathering feedback from you in order to improve our services and continue to offer features that you prefer.

Social Media Accounts

To create an account on our Websites/Apps or to participate in certain features, our Websites/Apps may allow you to chose to let us access information from accounts you have created on social media sites such as Facebook, Twitter, Pinterest, Instagram, and other similar sites (“Personal Social Media Accounts”). If you chose to allow us access to your Personal Social Media Accounts, Abercrombie & Fitch could collect some, and possibly all, of the data in the Personal Social Media Account to which you grant access. Depending on the terms of the social media site, this information could include: your name, email address, profile picture, gender, networks, user ID, list of friends, date of birth, likes, education history, work history, current city, hometown, interests, relationship status, and location. Once you grant this permission, Abercrombie & Fitch will be able to continue to be linked to the permitted Personal Social Media Account and collect information without a further request for permission, which could include later revisions to existing information or new types of information that you add. If you no longer want your Personal Social Media Account(s) linked to our Websites/Apps, click on the ‘disconnect’ link located on our Websites/Apps near the corresponding social media button and we will stop collecting this information. You may also be able to stop our ability to link to information in your Personal Social Media Account by following instructions provided on the applicable social media sites.

Mobile Application

We offer Apps for download to your mobile device that provide you with various interactive features.

The collection and means of collecting information, as well as the use and sharing of information, through any currently existing or future App are discussed in this policy.

In addition:

  • Use of some features of an App will ask for permission to access data on your mobile device, such as your photos. We will only access this data if you provide consent when asked by the App. Please note, some features of the App are only available if you allow us to access the requested content.

  • If you provide consent when asked, the App will send push notifications ("Notifications") to your mobile device. These Notifications can be sent to you and viewed by you even if you are not actively using the App. The Notifications may be specific to your interactions with us and may be location-specific if you have consented to location-based services.

Information We Share with Third Parties

1. Email Addresses

We do not sell, or grant rights to external third parties, to use your email address for their own marketing purposes.

Please note, if you request to be removed from our email marketing list, you may still receive email confirmations from us regarding any orders placed by you on our Websites, or other operational emails.

2. Postal Addresses

We make the names and postal addresses in our postal mailing list, sometimes categorized by purchasing information, available to our affiliates (for example, Hollister Co. and abercrombie kids) and other unaffiliated companies for their marketing purposes. 3. Service Providers

Please be aware that we may share information collected with third parties to assist us with our e-commerce business, such as our Websites, Apps, and communications, and our Social Media Pages. All of the information gathered through our Websites, Apps, and communications that you provide to us is sent to the United States and Japan. Sale Terms

Terms that we have used in these sale terms are defined in the "Definitions" section below.

These sale terms set out the terms and conditions that will apply when you purchase merchandise through our site. If you are unable to understand or have any questions about these sale terms, please contact us using the contact information set out in the "Contact Us" section below. You will be required to confirm that you have read and accept these sale terms before you submit an order to us.

Prior to submitting an order by clicking the 'SUBMIT ORDER' button in checkout, please save or print a copy of these sale terms to keep on file for future reference regarding the order you are submitting. Please note, terms are subject to change so review and save or print a copy of these terms prior to each order that you submit.

1. Order and Acceptance

A. If you would like to order merchandise, you can use the order process on our site to submit an order.

B. Each order submitted constitutes an offer to purchase merchandise from us. Orders are subject to our acceptance and we may, at our discretion, refuse to accept your order, including where:

  • orders cannot be packed due to an error in information you have provided to us, for example, where you provide us with: incorrect payment information; incorrect billing information (e.g. where the billing information you provide is different from the information that the bank or building society which issued your payment card has on record); insufficient or an incorrect shipping address (i.e. street address, city, country or postcode); or fraudulent information;
  • there is an error on our site relating to the merchandise that you have ordered, for example an error relating to the price or description of the merchandise as displayed on our site; or
  • the merchandise that you have ordered is no longer available through our site.
  • you have missed delivery of an order three (3) or more times through our Cash on Delivery (COD) service.

C. Once we have received your order through our site, we will send you an email to the email address that you have provided to us acknowledging receipt of the order.

D. If we are unable to accept your order, other than for fraudulent purposes, we will send an email informing you of the reason for the rejection.

E. If you do not receive an email, call us at 0066-33-813058 (9:00 to 17:00 JST, Monday to Friday) or at +1-925-206-3124 before you try to place another order for the same merchandise. You should note that the email that we send to you confirming receipt of your order does not constitute acceptance of your order, only an acknowledgement that we have received it.

F. After receiving your order, we will check that the relevant products are in stock. For non-COD orders our contract will only be concluded and Abercrombie & Fitch will only be deemed to have accepted your order (or any part of your order) once the requested merchandise has been shipped and we have sent a shipment confirmation email to you confirming that all or part of the merchandise ordered is still available and has been shipped. The contract will only relate to that part of the order of merchandise which has actually been shipped and no contract will have been created in respect of any merchandise which you may have ordered which we were unable to ship. If you have chosen to complete payment with our COD service our contract will only be concluded and Abercrombie & Fitch will only be deemed to have accepted your order once you have paid for the order from our COD service.

G. We will take reasonable steps to ensure that the prices and other information about merchandise on our site are accurate. However, it is always possible that despite our efforts, some of the merchandise may be incorrectly described or incorrectly priced on the site. If an error relates to merchandise for which you have placed an order, we may reject your order under clause 1(B) above. If we reject your order because of an error, we will notify you that your order has been cancelled at the email address that you have provided to us and ask you whether you would like to re-submit your order to purchase the relevant merchandise once we have corrected the error. If we have notified you that we have accepted your order and you have received a shipment confirmation email, you will not be required to pay more than the price that was displayed on our site at the time that you placed your order for the merchandise that you have requested, and if we have sent you merchandise which is different from the description of the relevant merchandise on our site at the time that you placed your order, you will also have the right to return it within thirty (30) days from delivery. 2. Product Availability

A. The inclusion of any merchandise on our site does not imply, warrant or guarantee that the merchandise will be available if you wish to place an order to purchase it.

B. We will have the right, at any time, to make changes to information about merchandise displayed on our site, for example information about prices, description or the availability of merchandise, and we may do so without first giving you notice of the changes. We will not, however, make any changes to the price, availability or description of any merchandise after we have accepted an order to supply the merchandise to you.

C. Gift Cards purchased at an Abercrombie & Fitch store may only be redeemed at an Abercrombie & Fitch store in the country in which they were purchased.

3. Customer Initiated Order Cancellations and Changes

A. You can make changes to or cancel your order at any time before your order has been packed by us. To make changes to your order, please call us at 0066-33-813-058 (9:00 to 17:00 JST, Monday to Friday) or at +1-925-206-3124. If your order has already been packed, you will only be able to return the merchandise. Please see the terms of our return policy listed below.

5. Delivery

A. This site ships merchandise to Japan only.

B. Please note that we cannot

  • 1. ship certain fragrances and body care products; or
  • 2. deliver your order to a freight forwarding company.

We will refuse to accept your order if you request that we do either of the above.

D. Merchandise that we deliver to you will become your property at the time that you receive it. As soon as we have delivered the merchandise to you, you will become responsible for it, and for any loss or damage to it thereafter.

E. If you choose to use COD, on the day your order is scheduled to arrive, a representative from the COD service will contact you via the phone number you provided at checkout to arrange a convenient time for delivery. This representative may only speak Japanese. You will need to be at the confirmed shipping location in person to receive and pay for your merchandise. You are welcome to inspect the package before accepting and paying for it.

6. Merchandise on Backorder

A. Please note that payment for any merchandise on backorder will not be taken from your payment card until the merchandise on backorder is shipped and a shipment confirmation email has been sent to you. Shipping and handling for each item in an order is distributed so it is directly proportional to the cost of an item and will not be charged in the applicable proportional amount until the respective item(s) ship(s). All items in an order will be shipped via the shipping service type selected when placing the order. If you pay for your order using Pay-Easy or Convenience Store, then payment for the entire purchase will be taken when you submit your order and complete payment on their third party site.

B. Merchandise on backorder is temporarily out of stock. If A&F is unable to ship any merchandise on backorder within seven (7) days from the date on which the item backorder email was issued, we will notify you at the e-mail address that you have provided. You will not be charged for merchandise on backorder until it has been shipped. Shipping and handling for each item in an order is distributed so it is directly proportional to the cost of an item and you will not be charged in the applicable proportional amount until the respective item(s) ship(s). All items in an order will be shipped via the shipping service type selected when placing the order. The status of a backordered item will remain open in an order until: (i) the merchandise is in stock, A&F has taken payment, and A&F has shipped the merchandise; (ii) A&F has contacted you to inform you that an item has been cancelled; or (iii) you contact A&F for the purpose of making a change to or cancelling your order.

C. You can cancel your order for merchandise on backorder at any point prior to the packing of your order by calling us at 0066-33-813058 (9:00 to 17:00 JST, Monday to Friday) or at +1-925-206-3124.

7. Prices and Payments

A. We reserve the right to vary the price of our merchandise at any time. We will not alter the price of any merchandise covered by an order after we have accepted the order.

B. You may pay for your order using either a credit card from Visa, MasterCard, JCB or American Express, a debit card with a Visa or MasterCard logo, PayPal, Pay-Easy or Convenience Store. Debit payment methods will be processed as credit. You may pay, in local currency, upon delivery of your merchandise using our COD service.

C. When we receive your order, we will place a "hold" on your Visa, MasterCard, JCB or American Express, or PayPal account for the total value of your order. If the "hold" on your card or account has been authorized by your bank or card issuer we will take payment when your merchandise, or the first part of the merchandise that you have ordered, is dispatched. If you pay for your order using Pay-Easy or Convenience Store, payment will be taken when you complete the payment process on the Pay-Easy or Convenience Store third party site. You should note that placing a "hold" on your Visa, MasterCard, JCB, or American Express, or PayPal account or taking payment does not constitute acceptance of your order. Our contract is created only when we send you an email confirming that we have dispatched your merchandise or the first part of the merchandise covered by your order.

D. The charge for your order will appear on your payment statement as "AFH Japan, G.K." If you wish to dispute the validity or amount of a charge that appears on your payment statement, please contact us by emailing us at Orderservice@Abercrombie.com.

E. If you cancel an order under clause 3 above, any authorized "hold" on Your Visa, MasterCard, JCB, or American Express, or PayPal account will usually be released within three (3) to five (5) working days from the date of cancellation. If you used Pay-Easy or Convenience Store and cancel an order, or an item in your order, you will receive an email with a link that you will need to access in order to provide bank details to process a return. After this is completed, you will receive a refund within seven (7) to fourteen (14) business days.

F. The prices displayed on our site for merchandise ordered for shipment to Japan are inclusive of all applicable taxes. Taxes for merchandise will be refunded to the customer with merchandise returns. Consumption tax specifically on shipping and handling charges are included in the shipping and handling fee. The shipping and handling fees are not refundable with merchandise returns, unless required by law.

8. Resale / Reshipping of Our Merchandise

A. It is important for us to monitor the quality of the merchandise that our customers purchase in order for us to maintain customer satisfaction and therefore you must not misrepresent yourself as being one of our authorized resellers or as being qualified to resell our merchandise. We reserve the right to refuse to accept your order if we suspect that you intend to resell our merchandise.

B. ENGAGEMENT WITH ABERCROMBIE & FITCH AFFILIATES Abercrombie & Fitch, Hollister Co., and abercrombie kids (the "Company”) reserves the right to block from receiving marketing communications or to remove and unsubscribe from all Company platforms any email address, phone number, and/or mailing address associated with customers determined by the Company to have characteristics of reselling and/or customer orders determined by the Company to be fraudulent. Company platforms affected by such removal include but are not limited to: (i) any of the Company’s online accounts; (ii) promotional club memberships; (iii) email marketing lists; (iv) text messaging programs; or (v) direct mailing lists. In addition, affected customers may be prohibited from accessing or registering for all of the aforementioned platforms in the future.

9. Returns / Refunds

A. If you are not satisfied with the merchandise that you ordered, you may return it to us for a refund within thirty (30) days from delivery. All purchases made at an Abercrombie & Fitch Japan store need to be returned or exchanged to an Abercrombie & Fitch Japan store.

B. If you are not satisfied with your merchandise you have ordered using our COD service you can refuse the order at the time of delivery. If you choose to refuse an order, the entire order must be returned with all of its contents and packaging. If there is a single item you do not wish to keep, you can return it to any Abercrombie & Fitch store in Japan or to Abercrombie & Fitch Returns Department, Gridlines 9001W to 9020W (inclusive) of 9th Floor, ATL Logistics Centre, Phase(s) B, Berth No.3, Kwai Chung Container Terminal, Kwai Chung, New Territories, Hong Kong separately within thirty (30) days after accepting the order. There are no exchanges, so you can either refuse your package at the time of delivery or return individual items using the return guidelines below.

Refunds for Faulty Merchandise

C. If you wish to return merchandise for a refund which is faulty or otherwise damaged when you receive it, which does not correspond to the description on our site, or which develops a fault after you receive it, you can do so within thirty (30) days of delivery by: (i) returning the merchandise to any Abercrombie & Fitch store in Japan (ii) emailing us at Abercrombie@Abercrombie.com or (iii) calling us at 0066-33-813058 (9:00 to 17:00 JST, Monday to Friday) or at +1-925-206-3124. When you call or email us, we may give you the option of emailing or posting to us a photograph of the faulty, damaged or non corresponding merchandise. If you call or email us to request a refund, we may ask you to return the merchandise to us before we can process your refund. Merchandise must be returned in its original individual packaging where applicable (e.g. fragrance, shoe, or accessory boxes, etc.). When you return the merchandise to us, please remember to include details of why you consider that the merchandise is faulty, damaged or does not correspond to the description on our site.

You should note that we cannot process your refund if you return merchandise purchased online by post to one of our stores.

D. Once we receive the merchandise and confirm that it is faulty, damaged or does not correspond to the description on our site, we will refund to you the cost of the merchandise and original shipping and handling charges paid by you. If you show us how much it cost to return the merchandise to us, we will also refund to you the cost of your return postage. If you used COD as a payment method we will return to you the ¥324 COD service fee. We will usually credit the refund back to the original payment type, unless we have provided another option and you have expressly agreed otherwise. The refund will be made back to your original payment type within approximately fourteen (14) days from the date that we receive the merchandise, although it may take a while longer for the refund to show up on your payment statement. If you used Pay-Easy, Convenience Store or COD, you will receive an email with a link that you will need to access in order to provide bank details to process a return. After this is completed, you will receive a refund within seven (7) to fourteen (14) business days.

E. If we examine the merchandise that you have returned to us and, in our reasonable opinion, do not consider that it is faulty, you will not be entitled to a refund and we will return the merchandise to you.

Refunds for Non-Faulty Merchandise

F. If you are not satisfied with any merchandise that you have received, or we have emailed you to confirm that your order has been packed, but you would like to cancel it, you may request a refund within thirty (30) days from delivery by: (i) returning the merchandise to any Abercrombie & Fitch store in Japan (ii) mailing the merchandise back to us at: Abercrombie & Fitch Returns Department, Gridlines 9001W to 9020W (inclusive) of 9th Floor, ATL Logistics Centre, Phase(s) B, Berth No.3, Kwai Chung Container Terminal, Kwai Chung, New Territories, Hong Kong, (ii) emailing us at Abercrombie@Abercombie.com or (iii) calling us at 0066-33-813058 (9:00 to 17:00 JST, Monday to Friday) or at +1-925-206-3124. If you call or email us, we will still need you to return the merchandise to us. Merchandise must be in resalable condition and returned in its original individual packaging where applicable (e.g. fragrance, shoe, or accessory boxes, etc.). You need to keep merchandise for which you have requested a refund in your possession and take reasonable care of it until it is returned to us.

You should note that we cannot process your refund if you return merchandise purchased online by post to one of our stores.

G. We will make the refund to the same payment type you used for the initial order. If you used Pay-Easy, Convenience Store or COD you will receive an email with a link that you will need to access in order to provide bank details to process a return. After this is completed, you will receive a refund within seven (7) to fourteen (14) business days. If you accept an order though our COD service then request a refund, you will not be refunded the cost of the COD service.

10. Our Liability to You

A. Nothing in these sale terms will exclude or limit our liability to you for any damaged caused by our intentional act or gross negligence, or fraud, death or personal injury caused by our negligence, or for any other liability which may not be excluded or limited under applicable law.

B. We will not be liable to you under a contract for:

  • any loss of profit, loss of income, loss of business, loss of revenue or loss of goodwill;
  • any loss or corruption of or damage to data; or
  • any loss or damage which was not a reasonably foreseeable result of either our breach of a contract or our breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time that we and you entered into a contract, such loss was either contemplated by us and you or you notified us that the loss may occur if we breached the contract or our legal duty of care.

C. Nothing in these sale terms will affect your statutory rights. For further information about your statutory rights you should contact your local authority National Consumer Affairs Centre, Ministry of Economy, Trade and Industry or their relevant agencies or bureaus.

A. When you place an order through our site, you will be providing us with your personal information. Our collection and use of your personal information will be carried out subject to the terms of our Privacy Policy, a copy which can be found by clicking here.

13. General Terms

A. The contract between you and us is governed by the laws of Japan. Either you or we may bring legal actions in respect of any dispute which arises in connection with a contract in a relevant court in Japan.

B. If either you or we do not enforce or delay enforcing any of our rights under a contract, this will not stop us from doing so at a later date.

C. If any provision of a contract is not valid or legally enforceable, that term will be deleted and the remaining terms will not be affected.

D. No party other than you or us has any right to enforce any term of a contract.
